Vendor Privacy Policy

In this Vendor Privacy Policy, the words “you” and “your” refer to each service provider who is using the platform. The words “we”, us”, “our”, “ApnaMechanik” or “company” refer to Revotech Service Media Private Limited, its subsidiaries, and affiliates. The Vendor Privacy Policy governs your use of the website, mobile application and services available under the domain www.apnamechnik.com and mobile applications (hereinafter referred to as the “Platform”).

By using the platform, you agree to be bound by the following: (i) Vendor Privacy Policy; (ii) Vendor Terms of Use; and (iii) Disclaimer including any future amendments herein. That the Vendor Privacy Policy, Vendor Terms of Use, and Disclaimer shall hereinafter may be referred to collectively as the “Policies”. You also agree that by using the Platform or use any of the services, made available on the Platform, you have read and understood the Policies mentioned herein, as together the said Policies forms a binding agreement (the “Agreement”) between you and/or the company/firm/corporate body you are representing and the company regarding your use of the Platform and the services provided on the platform.

This Vendor Privacy Policy is our commitment with respect to online privacy and we recognise and fulfil appropriate protection & management of Personal Information as shared by you with us.

1. ACCEPTANCE
1.1. The following Vendor Privacy Policy governs your use of the platform, services, materials and documents made available to you on the platform. By creating an account on the platform or by using the Services, you signify electronically your acceptance to all Policies, terms, conditions, and notices contained or referenced herein and to comply in accordance with the present Vendor Privacy Policy and other policies.
1.2. If you do not agree to be bound by these Vendor Privacy Policy and other policies, you may not use the platform in any way.
1.3. If this Vendor Privacy Policy conflicts with any other document, this Vendor Privacy Policy will prevail for the purposes of usage of the Site.

4. INFORMATION THAT MAY BE COLLECTED FROM YOU?
4.1. We collect the details provided by you on registration together with information we learn about you from your use of our service and your visits to the platform and other websites accessible from them.
4.2. Kindly note that we do not collect your Payment Card details (i.e. credit/debit card number, expiration date, CVV etc.). We may collect information in connection with your participation in any promotions or contests offered by us and the information you provide when giving us feedback or completing profile forms. We also monitor customer traffic patterns and platform use, which enables us to improve the service we provide. We will collect only such information as is necessary and relevant to us to provide you with the services available on the platform.

4.4.4. PIN/ZIP code. – Demographic profile (like your age, gender, occupation, education, address and product owned);
4.4.5. Your opinion on services, products, features on the platforms;
4.4.6. Goods and Services Tax Number, Permanent Account Number, Bank Account, IFSC, MMID, Aadhar, FSSAI, union membership details; and
4.4.7. Business name, brand name, trademark details, store address and office address.
4.5. We may also collect the following information about:
4.5.1. The pages you visit/access;
4.5.2. The links you click on the platform;
4.5.3. The number of times you access the page;
4.5.4. Things you view, add to bag, add to wish list; and
4.5.5. Other websites you open simultaneously while browsing on ours.
4.6. You may terminate your account at any time by writing to us at support@apnamechanik.com from the email ID you have used for creating your account login, and mentioning “Please close my account” in the subject line. However, your information may remain stored in archive on our servers even after the deletion or termination of your account.

5. HOW DOES WE USE THE INFORMATION IT COLLECTS?
In addition to the examples provided above, we will share your information in the following manner:
5.1. Service Providers- We provide access to or share your information with operations and maintenance contractors and other third parties who perform services on our behalf. They have access to perform these services but are prohibited from using your information for other purposes. They provide a variety of services to us, including billing, sales, marketing, test proctoring, couriers, mentoring, recruitment consulting, product content and features, advertising, analytics, research, customer service, data storage, security, fraud prevention, credit facilities, payment processing and legal services. Moreover, in certain circumstances, we may share certain Personally Identifiable Information and materials with third parties including, but not limited to, service providers such as Facebook or WhatsApp in order to provide you services that you have requested or services that ApnaMechnik provides in conjunction with the Services. Also, we use certain third-party platforms to collect your information (such as Typeform or Google Forms), as a consequence of which, your information may be stored on their servers.
5.2. Government and Regulatory Disclosure- ApnaMechnik may share your Information with various government authorities in response to court orders or other legal processes to establish or exercise our legal rights or to protect our property; to defend against legal claims; or as otherwise required by law. In such cases, we reserve the right to raise or waive any legal objection or right available to us. We may also share your information when we believe it is appropriate to investigate, prevent or take appropriate action regarding illegal or suspected illegal activities; to protect and defend the rights, property, or safety of ApnaMechnik, the Platform, our users, customers, or others; and in connection with our Terms and other agreements.
5.3. Associates and Business Transfers- ApnaMechnik may share your Personally Identifiable Information with any Associate. The term “Associate” includes, with respect to any person, any entity that is controlled by such person, or any entity that controls such person, or any entity that is under common control with such person, whether directly or indirectly, or, in the case of a natural person, any Relative (as such a term is defined in the Companies Act, 1956, and Companies Act, 2013, to the extent applicable) of such a person. ApnaMechnik may disclose and/or transfer your Personally Identifiable Information to an acquirer, assignee or other successor entity in connection with a sale, merger, or reorganisation of all or substantially all of the equity, business or assets of ApnaMechnik to which your Personally Identifiable Information relates.

5.4. Business Partners- With your consent, ApnaMechnik may share information that can be used to directly contact you with third-party business partners, such as companies that may be offering products or services or other opportunities that may be of interest to you.

6. WITH WHOM WE SHARE MY INFORMATION?
Under no circumstance do we share Personally Identifiable Information for any commercial or marketing purpose unrelated to the delivery of our service without asking you first. Our service technicians and other employees have supervised access to your information. We will disclose information to law enforcement, or to comply with other legal requests, only if provided with sufficient and appropriate legal process.

7. HOW LONG DOES WE SAVE MY PERSONAL INFORMATION AND HOW CAN I DELETE IT?
We store your Personally Identifiable Information on cloud servers for as long as you remain our buyer/seller/broker/transporter/dispatcher in order to provide you with the service. All information is encrypted and cannot easily be accessed.

8. BROWSER COOKIES- We may use cookies to enhance user experience or for delivery of our services. Our web servers automatically collect limited information about your computer connection to the Internet, including your IP address, when you visit the platform.

9. INFORMATION FROM PROMOTIONS- We collect information you give us when you participate in a promotion. Specifically, you will typically be asked to provide your name and email address, and possibly other information such as your mailing address and telephone number.

10. OTHER INFORMATION- We may retain any data you provide to us in an email inquiry, for the purpose of tracking the types of questions we receive.

11. CHANGES TO THIS POLICY- We may from time to time update this Vendor Privacy Policy. In the event that we merge with, or is acquired by another company, a change to this Vendor Privacy Policy may result. Whenever a change to this policy is significant, we will place a prominent notice on the platform.

12. YOUR CONSENT- By using the Products and Services you consent to the collection and use of information by the Company. If we decide to change our Vendor Privacy Policy, we will post those changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it.
Regardless of any changes we make to our Vendor Privacy Policy, we will always use your personal information in accordance with the version of the policy in place at the time you provide your information, unless you give your express consent for us to do otherwise.

OTHER WEBSITES- For your convenience, this platform contains links to other websites, including some websites administered by the company or administered by other companies on behalf of us, as well as to websites unrelated to us. This Vendor Privacy Policy does not apply to these linked websites. Each website should be checked for its own Vendor Privacy Policy.

14. INFORMATION SECURITY- We do not collect sensitive personal data like; financial information such as Bank Account details or Credit Card or Debit Card or other payment related details; and any other sensitive information which is confidential or sensitive by its nature. We do not store information of users like the password of your email account. However, we cannot guarantee encryption or the privacy of your personal or sensitive details.

15. DISCLOSURE OF YOUR PERSONAL INFORMATION- You agree and confirm that we do not rent, sell, or share Personal Information about you with other people (save with your consent) or non-affiliated companies except to provide our Services or under the following circumstances;

15.1. To provide the Personal Information to trusted partners who work on behalf of or with us under confidentiality agreements. These entities may use your Personal Information to help us communicate with you about offers from us and our marketing partners;

15.2. To respond to summons, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims to share Personal Information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Terms of Use, or as otherwise required by law;

15.3. To transfer Personal Information about you if we are acquired by or merged with another company. In this event, we will notify you before information about you is transferred and becomes subject to a different Vendor Privacy Policy.

15.4. To transfer Personal Information about you to trusted partners, may or may not for gain, to promote certain products/services for commercial purposes, without any prior notice to you.

15.5. Please remember that if you post any of your Personal Information in public areas of the platform such as in online forums or chat rooms, or in the platform’s searchable resume database, such information may be collected and used by others over whom we have no control. We are not responsible for the use made by third parties of information you post or otherwise make available in public areas of the platform.

16. WHAT SECURITY PROCEDURES ARE IN PLACE TO PROTECT INFORMATION FROM LOSS, MISUSE OR ALTERATION
16.1. To protect your privacy and security, we will verify your identity before granting access or making changes to your personally identifying information. If you have registered your profile on the Platform, your User ID and Password are required in order to access your profile information.
16.2. Although we will endeavour to safeguard the confidentiality of your personally identifiable information, transmissions made by means of the Internet cannot be made absolutely secure. By using this platform, you agree that we will have no liability for disclosure of your information due to errors in transmission or unauthorised acts of third parties.
16.3. We follow generally accepted industry standards to protect the personal information and email addresses submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information and email address, we cannot guarantee its absolute security.
16.4. All information gathered on the site is securely stored within our controlled database. The database is stored on servers secured behind a firewall; access to the servers is password-protected and is strictly limited. However, as effective as our security measures are, no security system is impenetrable. 17. DISCLAIMER- The Company does not access, store or keep credit card data. Accordingly, the Company shall not be responsible or liable for any loss or damage due to any disclosure whatsoever of Personal Information. The Company shall not be liable for any loss or damage sustained by reason of any disclosure (inadvertent or otherwise) of any Personal Information concerning the User’s account and / or information relating to or regarding online transactions using credit cards / debit cards and / or their verification process and particulars nor for any error, omission or inaccuracy with respect to any information so disclosed and used.

18. ASSIGNABILITY- The Company may assign any of its responsibilities/obligations to any other person without notice to the User, at its sole discretion. However, you shall not assign, sub-licence or otherwise transfer any of your rights under this Vendor Privacy Policy to any other party, unless a written consent is taken from the Company.

19. GRIEVANCE- The Company shall address any discrepancies and grievances that you may have regarding the platform or use of the Services in a time bound manner.
